Alexa J. McClaren-Nabavi practices Aboriginal law, with particular experience in the area of consultation and accommodation. Alexa has represented First Nations on a wide range of issues including treaty negotiations, consultation and accommodation negotiations, governance matters, business development, specific claims, environmental law, administrative law, human rights and labour and employment law. Alexa has appeared before the BC Supreme Court.

 
Prior to attending law school Alexa completed a Bachelor of Arts and Masters Degree in History.  Her focus was in the area of Aboriginal Relations in British Columbia and Residential Schools.  She also worked for the Federal Treaty Negotiation Office in Victoria and Vancouver and for Claims and Indian Government in Whitehorse for five years during which time she participated in the negotiation of land claims and self-government agreements.  Throughout law school Alexa worked at TransCanada Pipelines where she provided advice on consultation matters.  Alexa articled with a large national law firm in Alberta.  After being called to the bar in British Columbia, Alexa worked as in-house legal counsel for a prominent British Columbia First Nation.  Alexa has been an Associate at Maurice Law since October, 2006.
 
Examples of some of the areas in which Alexa has focussed her practice are:

·        Treaty Negotiations - acting as part of a negotiating team, providing advice on the client’s mandate and negotiating with First Nations and with federal, territorial and provincial governments; drafting chapters; preparing position papers and negotiating and reviewing documents related to treaty negotiations; providing advice to senior officials and consulting with various government departments in Ottawa; facilitating discussions with internal government departments on mandates; drafting ministerial briefing notes

·        Public Facilitation – taking part on local and regional advisory committees and working to advise the public with respect to treaty negotiations 

·        Consultation and Accommodation - coordinating and assisting with responses to referrals; participating in environmental assessments and formal reviews of major projects; negotiating and drafting benefit sharing agreements and impact and benefit agreements; negotiating and drafting forestry agreements and watership accord agreement; participation with First Nations in internal consultation processes including consultation with Elders`  Advisory Committees; coordinating and facilitating consultations with federal, provincial, municipal and local governments on behalf of First Nations; participating in and advising First Nations with respect to negotiations with private industry and drafting impact and benefit agreements  

·        Governance – providing advice to clients on election codes and constitutions; providing advice to clients and interpreting land claim agreements; helping to develop and review internal governance procedures; negotiating agreements; advice and representation on labour and employment and administrative disputes

·        Business Development - drafting and reviewing tenures and various commercial agreements; providing advice to clients on leased land and negotiating and drafting lease agreements for Band Lands; reviewing lease agreements and providing advice on the development of Band Lands; negotiating with third parties for access to Band Lands and Reserve Lands

·        Specific Claims - overseeing research and drafting claims under the federal Specific Claims Process

·        Human Rights – providing advice to First Nation governments and individuals on their rights and responsibilities under the Human Rights Act and providing advice to First Nation governments against claims made against them under federal and provincial human rights legislation

·        Evidence – providing advice to First Nations on the collection of oral evidence
